Capital punishment has a history dating back nearly 4,000 years, but its use has only recently been curtailed. A system of justice tempered by mercy has emerged due to changes in the law, research on sentencing patterns, monitoring by civil rights groups, and various Supreme Court decisions.

Most contemporary intellectual attention to capital punishment has come from proponents of penal reform, as a principled, moral evaluation of law and social practice, or as part of theories of the modern state and sovereignty.

Capital punishment, also known as the death penalty, is the execution of an offender sentenced to death after being found guilty of a criminal offense by a court of law. Extrajudicial executions carried out without due process of law should be distinguished from capital punishment.

The terms death penalty and capital punishment are sometimes used interchangeably, though the imposition of the penalty does not always result in execution (even when upheld on appeal), due to the possibility of commutation to life imprisonment.

However, depending on the country and the judiciary system in place, capital punishment has a variety of different execution procedures. Hanging, firing squad, electrocution, gas chamber, and lethal injection are some of the most commonly used methods.

Capital punishment has long been the subject of heated debate over its morality and impact on criminal behavior. Contemporary arguments for and against capital punishment can be broadly grouped into three categories moral, utilitarian, and practical.
